Terms and Conditions
- It is the buyer's responsibility to review and judge vehicle conditions before bidding.
- All vehicles are sold as is, where is. There are no warranties expressed or implied.
- Once vehicle is paid in full it is NOT The Hammer Time Auto Auction responsibility for any mechanical damages as the vehicle should have been checked prior to purchase.
- The Hammer Time Auto Auction is not reliable for any surface rust on the body on vehicle. However, if there is structural/ frame damage it has to be reported within 48 hours of auction day. After 48 hours there will be no arbitration.
- It is important to remember the light system and how it works:
- Green Light: Arbitration Period- Implies that the car should drive per seller, before paying for the vehicle be sure and check the vehicle out and make sure powertrain (motor and transmission) are in working condition. If there is an issue that is over a $500 repair, then you can arbitrate the vehicle only if your bid was $1,550 or higher on a green light.
- Yellow Light: Announced Condition- On a green light vehicle, the seller can announce a condition for which the vehicle CAN NOT be arbitrated for such as, check engine light, misfire, a noise within the vehicle, etc.
- Red Light: Auction sales are final no matter the amount the vehicle is sold “as-is”, meaning no warranties expressed or implied.
- Blue Light: Dealers have 30 days to produce a title to us once the vehicle is sold. If not the buyer can bring vehicle back and be refunded in full as long as the car is in the same condition when purchased.
- It is very important to inspect the vehicles before bidding and/or paying.
- All bidders must register before each sale and have a bidder number issued by The Hammer Time Auto Auction.
- The sales sheet/run list may change at any time. Bidders rely solely on their own observations and inspections in determining whether to buy a vehicle.
- Payment for vehicles must be in cash, Cashier's Check, Money order, or Credit Card (with 3.5% fee).
- Vehicles must be paid in full and removed by the following Tuesday after the sale. Any late payment that will be charged at $30 per day for up to 10 days. Vehicles left after 10 days will be added to the next auction and the non-paying bidder will be banned.
- Failure to remove the vehicle from the property after payment will result in storage fees of $30 per day. Vehicles left after 10 days may result in a lien imposed upon the vehicle.
- The auction is not responsible for loss or damage to vehicles that are not immediately paid for and removed from the property.
- The Hammer Time Auto Auction hereby disclaims and excludes any and all warranties of title, including without limitation that the title is good and its transfer is rightful, and that the vehicle is free from any security interest or other lien or encumbrance. The Hammer Time Auto Auction also disclaims and excludes any and all warranties that the vehicle is free from any rightful claim of any third party by way of infringement or the like. All vehicles are sold “AS IS WITH ALL FAULTS”. The Hammer Time Auto Auction hereby disclaims and excludes any and all implied warranties, including without limitation the implied warranties of merchantability and fitness for a particular purpose.
- The sole and exclusive remedy for breach of contract of warranty shall be the return of the vehicle and repayment of the purchase price. Under no circumstance shall The Hammer Time Auto Auction be liable for consequential or incidental damage; including but not limited to repairs, improvements, loss of use, and DMV/Registration fees.
- The Hammer Time Auto Auction may have a lien and/or bid on items in the auction. By continuing I understand and agree to all of the terms and conditions stated above.
** NEW INSPECTION POLICY **
For $199.99 you can have a comprehensive inspection completed to confirm the vehicle is in overall good condition. This will include:
-Video of the vehicle running with hood open
-Test drive
-Vehicle put on lift for visual inspected
-Scan for codes
If you would like to have this done for a vehicle you have won, please let a worker know before paying for vehicle. You will pay for inspection first and if passes the buyer will be responsible for paying for vehicle. If it fails, then the buyer is not obligated to purchase the vehicle.
